As we approach the end of the spring legislative session, there are several ITLA-supported bills that we are keeping an eye on and hoping they pass this session. The first is HB 3359, the alternate juror legislation. The bill amends the Jury Act and the Code of Civil Procedure to increase the number of jurors and alternates in civil trials. Specifically, the bill allows judicial discretion to increase the number of alternate jurors to allow up to 4 alternates. The changes would apply to all civil actions commenced or pending on or after January 1, 2026. This bill has passed the House, and we hope to have it pass the Senate in May.
The second is SB 328, also known as the “Kilpatrick legislation.”
